Terms of Service

Effective: 1st October 2026 · Version: 1 · Between you and Gaurang C., doing business as Sustainability Markers Group (“SMG”, “we”).

1. Accepting these Terms

These Terms cover the Sustainability Markers iPhone app (“the app”). You accept them when you tap “Accept and continue” in the app. If they change in a way that matters, the app shows you a short summary of what changed and a link to the full new version, and asks you to accept it before you carry on. The full Terms are what apply, not the summary.

2. Who may use the app

The app is for staff of cities that subscribe to SMG, and for SMG’s own staff. You may use it only if SMG has granted you access at your city’s request. Access is personal: one person, one account.

3. Your account

  • Sign in with your own work email. Don’t share your account or sign-in codes.
  • For security, the app may ask you to sign in again from time to time, and signing in on another phone may sign out the first.
  • Tell us at info@sustainabilitymarkers.com if you think someone else has used your account.

4. Your city’s subscription

Your access depends on your city’s subscription with SMG, which your city arranges with us separately. If it ends or lapses, access stops. Your city decides who is on its list; SMG adds and removes people at the city’s request.

5. What the app shows

The dashboards combine data from public sources and utility providers with SMG’s analysis: forecasts, comparisons with your city’s targets, and commentary.

  • We check the data carefully, but it comes from third parties and can contain errors or gaps, and forecasts are estimates, not predictions we guarantee.
  • The app is information, not professional, legal, engineering or financial advice. Decisions made with it remain your city’s.

6. Files you upload

If you’re a city administrator, you may upload data files for your city.

  • Only upload files you’re allowed to share with SMG.
  • SMG reviews each file and may accept or reject it; we tell your city the outcome by email.
  • You give SMG permission to store, process and show the data in your city’s dashboards and, as yearly totals, on SMG’s public website. Tell us if a file or a category must stay out of the public website.

7. Using the app fairly

Don’t:

  • let anyone else use your account;
  • try to reach another city’s data or get around any security measure;
  • copy, scrape or download the app’s data by automated means, or take the app apart;
  • share SMG’s dashboards, forecasts or commentary outside your city. Your city’s own public materials are fine (council presentations, city reports, the city’s website) if the charts are unchanged, keep the watermark and credit SMG. Anything else, such as the press, other cities, consultants or commercial use, needs SMG’s written OK.

8. Who owns what

  • SMG owns the app and its dashboards, forecasts and commentary.
  • Source data belongs to whoever published it.
  • Your city’s uploaded data stays your city’s; section 6 covers what SMG may do with it.

9. Changes and availability

We may change or improve the app. Test builds (TestFlight) are pre-release and may change without notice. We aim to keep the app available but can’t promise it will always be.

10. Ending access

You can stop using the app at any time and delete your account in Settings.

Your access lasts as long as your city’s subscription. If it’s ending, because it expires without being renewed or is ended early, we’ll tell you at least 30 days before your access ends (or as soon as we can, if your city gives us less notice), by email and in the app. We keep your account for 90 days after that in case your city renews, then delete it.

We may also suspend or end access if these Terms are broken.

11. Disclaimers and liability

  • The app and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy and fitness for a particular purpose, to the extent the law allows.
  • To the extent the law allows, SMG is not liable for indirect, incidental, special or consequential loss arising from your use of the app or its content, including decisions made with it.
  • Nothing in these Terms limits liability that the law does not allow to be limited.

12. Law

These Terms are governed by the laws of the State of Washington, USA.
